Metaforerna och Rätten

Denna artikel visar hur kognitiv teori gallande metaforer och tankestrukturer kan justeras och sammanjamkas med valda delar av samhallsvetenskaplig teori, i syfte att bidra till rattslig analys och en rattssociologisk forstaelse av ratten. Artikeln betonar darmed vikten av en metaforanalys i syfte att kartlagga de underliggande tankestrukturer som konstruerar en specifik rattslig norm. Detta betyder i sin tur att rattsliga imperativ kan studeras i extrem detalj, och att exempelvis konflikter mellan sociala och rattsliga normer battre kan forstas i ljuset av tankestrukturella underliggande konflikter. Artikeln lyfter fram betydelsen av att se ratten som nagot forkroppsligat (embodied), dvs. beroende av begreppsliga lan fran en ofta fysisk, kroppslig eller spatial forstaelsegrund. Vidare lyfter artikeln fram begreppet ”metaforkluster” i syfte att poangtera hur vissa metaforer ar del i samma konceptuellt forankrade kluster, som relaterar till samma underliggande tankestruktur. Konsekvensen av detta ar att en metafor kan bidra till hur naraliggande metaforer ges mening, om de ar del i samma kluster. Detta betyder ocksa att rattsligt inkluderade metaforer kan fa argumentationsmassigt, retoriskt och meningsbyggande bistand aven fran utomrattsliga metaforer. (Less)
