A method and an apparatus for determining a maximum transmission power of a mobile terminal are provided to assess the additional number of backward links, which can be assigned to the mobile terminal, from a transmission power or headroom of the mobile terminal. The first power related parameter is provided for a network when a session starts(S100). Then, the second power related parameter is provided for the network(S102). The transmission of the mobile terminal is determined on the basis of the first and the second power related parameter(S104). The second power related parameter is cyclically provided for the network by using a set cycle interval(S106).
