Unctad Code on Transfer of Technology

The purpose of this paper is to review the developments in the negotiations for the code of conduct and give an overview of the legal regime which is likely to develop, keeping in view the key issues invoJved in the transfer of technology. Implications of transfer of technology for the economies of developing countries will be discussed, followed by the genesis of the draft international code of conduct. Further, the various provisions of the code and their scope will be scrutinised, keeping in view the international restrictive business practices, which have been usually detrimental to the economic development of developing countries. The draft code accommodates the special needs of developing countries concerning transfer of technology. Finally, the provisions dealing with settlement of disputes and applicable law in the draft code will be discussed, followed by conclusions.
