Jer 31,31-34 is in substance Jeremianic (not Deuteronomistic). It reflects the prophet's indebtedness to the Hosea tradition. He came to write off the Sinai-Horeb covenant (in a way unthinkable in a Deuteronomist), but could not believe that the uprooting of the nation would be the end of YHWH's plans for it. Otherwise what would become of the cosmic covenant (Hos 2,18-22; Jer 4,23-26; 5,22-23; 31,35-37)? In place of a covenant conceived in terms of marital imagery, a covenant subject to breakdown, Jeremiah postulated one based on unconditional parental affection, a covenant that would be made with the nation but would involve direct illumination of the individual.
