It will be not too much to say that the center of the future industry is IT industry. In order to ensure continuous growth of this industry, the property rights must be protected positively based on technologies. Unfortunately, however, contents of related reports indicate otherwise. The traditional or Western law model is composed of legislation, execution, and punishment in order. The Western laws are well arranged, positively executed, and take appropriate punitive measures if any violation of an individual is discovered. The individual will then mend his/her behavior while the society in general will get a good lesson from the exemplary punishment and refrain from illegal acts. However, the social reality cannot catch up with such smart structure. Software piracy is thriving and the infringement on intellectual property rights is rampant. The main concern of this writing is to examine whether a certain degree of affirmative changes can be induced based on the administrative guidance prescribed in Korea's administrative procedure act in case the traditional law model carries limitations in such reality. Administration guidance attempts to achieve objectives of administration based on voluntary cooperation from the other party. According to the traditional idea of laws, the feature of laws lies in the strong punishing power. Thus, the administration guidance is not a typical legal means. In a place lacking social consensus on the clear awareness of violation or lawfulness with respect to the modem industry witnessing rapid changes, we should pay attention to the utility carried by the administrative guidance procedure regarding the formation of such criteria and the compliance with the criteria thus created. For example, if the government implements strong crackdown jointly with related industries, there may be some effects on a temporary basis; however, as time goes by, we often see the situation regresses to the original state. In addition, the business paralysis incurred during the process of cracking down on illegal software is the social loss that should not be overlooked. We need to make efforts to improve such situation in a method where shock is relatively small and effects are long lasting, and such opportunity can be provided by the administrative guidance. In relation to this, it seems necessary to fully examine the side effects or the limitations of the administrative guidance.
