Digitaliseringens Rättssociologi. Om mätbarhetens behov av teori och den digitala arkitekturens normativa relevans

Den har artikeln for fram digitaliseringen och konsekvenserna av Internet som ett studieobjekt med inneboende mojligheter for metodutveckling inom rattssociologi och den bredare rattsvetenskapen – vilket i sin tur adresserar en teoretisk potential. Artikeln lyfter fram tre aspekter som det argumenteras for ar av sarskild vikt att adressera: 1.) de stora datamangdernas och matbarhetens metodologiska lofte; 2.) huruvida detta aven medfor ett behov av samhallsvetenskaplig teori, inklusive teoriutveckling; och 3.) i sa fall i vilken grad fokus darmed kan eller bor laggas pa den digitala infrastrukturens styrande funktioner eller normativa relevans, dvs. nar designen, ”koden” och protokollen – i nagon man – far rattsliga attribut. Dessa fragor kontrasteras i viss man till rattssociologiska klassikers teoribildning och vad det innebar att atertolka dessa i en ny kontext, i syfte att undersoka den rattssociologiska utvecklingspotentialen av dessa fenomen. Jag konstaterar aven avslutningsvis att den digitala samhallsutvecklingen rimligen ocksa leder till ett okat behov av tvarvetenskapliga samarbeten aven for studier som syftar till att teckna rattssociologiska fragestallningar, inte minst som en foljd av metodologiska overvaganden i relation till de enorma och komplexa datamangder som livet i det digitala samhallet genererar.
