OS RESÍDUOS ELETROELETRÔNICOS NO BRASIL E NO EXTERIOR: DIFERENÇAS LEGAIS E A PREMÊNCIA DE UMA NORMATIZAÇÃO MUNDIAL

Diante do crescimento exacerbado dos residuos eletroeletronicos (REE) e da ausencia de uma politica brasileira estruturada que defina as responsabilidades necessarias a organizacao de uma cadeia reversa de eletroeletronicos, escolheu-se comparar as legislacoes de Estados Unidos, China, India (todos grandes geradores de REE) e Suica (pais-modelo em gestao de REE), com a legislacao patria. Por meio de uma pesquisa qualitativa, adotou-se uma revisao bibliografica sistematica, que identificou semelhancas e divergencias legislativas acerca da gestao de REE entre os paises comparados. Assim, o estudo revela a necessidade de uma normatizacao brasileira que defina os papeis de cada ator envolvido na gestao de REE, bem como regras mundiais a fim de ser alcancada uma cooperacao internacional no compartilhamento de tecnologias de reciclagem e processos de producao e descarte sustentavel de REE.
