Copyright and Fair Use of Multimedia Resources

L'article rappelle l'histoire du droit d'auteur aux Etats-Unis, ainsi que la formulation du concept de fair use (usage legitime). Les principes du droit d'usage legitime et son application dans le secteur de l'enseignement superieur sont examines. Les directives du CONFU (Committee on Fair Use) etablissent les limites de l'utilisation d'oeuvres creatives dans la creation de projets educatifs multimedia. L'article examine egalement l'impact du numerique sur la protection du droit d'auteur et sur l'usage legitime au plan international, avec notamment les traites du WIPO (World Intellectual Property Organization). Il s'interesse aux efforts juridiques des Etats-Unis pour mettre en place ces traites, en particulier le Digital Millenium Copyright Act.
