중국 항만산업의 발전과 항만법 개선방향에 관한 연구

Since 1990, Chinese port industry and port system have grown enormously for the last 20 years. However, lawmaking for ports and port management in China was far behind her port's development. The Port Law of the People's Republic of China has barely promulgated and implemented on January 1, 2004, ending an embarrassing situation of no port law to follow from 1988. The China's Port Law 2004 defines a port management system for "the separation of the government and the enterprises" and regulates port planning, building, maintenance, running, and other port related activities. In this paper some contents of the China's Port Law 2004 concerning port management system, port planning, the use of Chinese coastline and port investment are surveyed. Some critical issues of the China's Port Law 2004 incompatible with the recent development of Chinese port industry are pointed out, and some comments and suggestions are made.
