Unfortunately, medical malpractice can occur for a number of reasons—error on the part of a surgeon, a missed diagnosis, prescribing the wrong medicine, delay in referral to tertiary care. This article focuses on treatment delay as a cause of action for medical malpractice. In our setting, time is of the essence in most cases, or the referring facility would not be calling for rapid transport to a higher level of care, so if our delay in providing transportation is the reason a patient is ineligible for time-sensitive therapy or other care, are we responsible for the suffering caused by illness progression?
