Legal Protection for Geographical Indications and Designations of Origin for Agricultural Products and Foodstuffs

We want to point out the legislation reffering to the geographical indices of food products (PGI) and the origine denomination of this products (PDO): „Salam de Sibiu”, „Magiun de Topoloveni” etc. This work contains the registration and the verication of this names in the UE Registers, the way of drowing up the duty notebooks and also the condition that must be accompished by the petitioners. In addition to the protection given for traditional products and organic, at the European level, to obtain protection for the two types of agricultural products and foodstuffs, and PDO - protected designation of origin and PGI - protected geographical indication. Until now, Romania has sent to Brussels a single product to obtain protection of geographical, five other manufacturers of traditional foods will start this year compiling documentation to obtain the protection of European geographical name. On the opposite side there are France and Italy, who hold over 40% of the total registrations. By inclusion of agricultural products or food in one of two categories, PGI or PDO, to obtain protection against any use of trade names registered which would allow exploitation of reputation (eg Salam Sibiu), abusive use, imitation or evocation of origin of any false or misleading information on the provenance, origin, nature or essential qualities of the product. Also, it will be avoid all other practices designed to mislead the consumer as to the true origin of the product.
